9th Circuit: Opportunity To Work Full Time Is Not Primary Issue

NEW ORLEANS – The Fifth Circuit U.S. Court of Appeals on Nov. 29 found that a disability insurer that denied benefits to a claimant who had the ability to work full time, just not the opportunity, did not abuse its discretion (Bruce Leipzig, M.D. v. Principal Life Insurance Co., No. 10-10394, 5th Cir.; 2010 U.S. App. LEXIS 24396).
